The following Terms of Membership (TOM) are between you (Member) and HOMEBASE IP (HBIP). The TOM prescribe your rights and obligation as a member of the HBIP community.
By accepting these TOM and using the products and services provided to you, you are bound by the terms and conditions listed henceforth and any wireless carrier’s “Service Agreement”, “Acceptable Use Policy”, or related document which governs a user’s responsible use of network resources and services as referenced by the wireless carrier on their website. Additional terms and conditions may also apply as summarized below for your benefit.
DESCRIPTION OF MEMBERSHIP:
ONE-TIME MEMBERSHIP FEE
Upon becoming a member, you are responsible for paying a One-Time Membership Fee for each subscription. This covers the EQUIPMENT (modem/router), setup, administration, and support of each subscription.
MEMBERSHIP DUES
MEMBER is responsible for paying the first month of service membership fee upon sign-up. Membership start-date is calculated as the day you receive shipment of equipment. Upon activation, your membership will renew on the 1st of each month and be prorated after the first month to adjust for start- date. Membership dues will automatically charge on the first of each month to the credit card on file. Credit card may be changed at member’s request., All subscriptions must have valid Credit card on file for autopay subscription renewal and to keep your service active. If insufficient funds available, credit card will be run daily until payment received. A $50 late fee will be assessed after the 5th of the month if payment is not received.
14-DAY RISK FREE TRIAL
Each membership includes a 14-day money back guarantee from the date of receipt of the provided equipment. If the Device or service does not meet member’s expectations, a refund for both the One-Time Membership Fee and Subscription will be issued when the undamaged Device has been returned in its original packaging. Device must be received with-in 30 days of cancellation in order to receive full refund. Devices returned after this period will not be entitled to a refund for either the One-Time Membership Fee or any Monthly Subscription services.
SUBSCRIPTION CANCELLATION
All devices are the property of Homebase IP and need to be returned in order to cancel a subscription.
Cancellation of any subscription can only take place when the device has been returned to Homebase IP and associated tracking information states that the unit has been received by Homebase IP.
Devices are required to be returned in the same way they were shipped. Please note that no modifications should be made to the device–this includes the addition of any adhesive or tape.
Devices that are not returned or are returned in an unsatisfactory manner will be subject to a device replacement fee of $350.
TECHNICAL SUPPORT
Technical Support is offered on all devices/subscriptions. Support may include shipping a replacement device.
All devices are the property of Homebase IP and must be returned within 10 days of receiving the new operating unit. Devices that fail to be returned within this window will be subject to a $350 Device Replacement Fee.
DOWNTIME CREDIT PRACTICE
Although rare, outages which result in service disruptions are eligible for downtime credit. Credit will be issued from date of contact about loss of service and will until the issue is resolved.
CONGESTION MANAGEMENT
We do not own, operate, maintain, or control the Service, and do not engage in network congestion management practices. The carrier uses network congestion management practices that may interfere with the speed or the availability of your Service. You should review the carrier’s disclosures for the network congestion management practices that may affect your use of the Service, including descriptions of congestion management practices; types of traffic subject to practices; purposes served by practices; practices’ effects on end users’ experience; criteria used in practices, such as indicators of congestion that trigger a practice, and the typical frequency of congestion; usage limits and the consequences of exceeding them; and references to engineering standards, where appropriate.
APPLICATION-SPECIFIC BEHAVIOR
We do not own, operate, maintain, or control the Service, and do not engage in the blocking or rate-control of specific protocols or protocol ports, nor do we modify any protocol fields or inhibit or favor any applications or classes of applications. The carrier may engage in one or more of those activities. You should review the carrier’s disclosures for application-specific practices by the carrier that may affect your use of the Service.
PROVIDED DEVICE RULES
The equipment used to access our service must be the original equipment provided by us to be used during the duration of membership and must be returned upon termination of membership. Membership constitutes ownership of membership and not ownership of any provided equipment (device) or carrier account that provided line is on. We will pass through or otherwise provide the warranties and technical support offered by the manufacturer and/or the carrier (if any).
SECURITY
We do not own, operate, maintain, or control the Service, and do not take any measures to assure the security of your use of the Service or the security of the network. The carrier may take action to guard your security in the use of the network and to safeguard the network. Please refer to the carrier’s open internet disclosures for additional information.
MODIFICATIONS
HBIP shall reserve the right at any time it may deem fit, to modify, alter and or discontinue, whether temporarily or permanently, our membership service, or any part thereof, with or without prior notice. In addition, we shall not be held liable to you or to any third party for any such alteration, modification, suspension and/or discontinuance of our Services, or any part thereof.
RELEASE
In the event you have a dispute, you agree to release HBIP (and its officers, directors, employees, agents, parent subsidiaries, affiliates, co-branders, partners and any other third parties) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected or unsuspected, disclosed and undisclosed, arising out of or in any way connected to such dispute.
